A California appellate court ruled in Groebner v Super. Ct. that in a probate case a demurrer can be filed at any time at or before the initial hearing.

California’s Code of Civil Procedure (CCP) specifies that a demurrer must be filed within thirty days of a complaint. The CCP applies to probate cases, except where the Probate Code provides otherwise, which it does in §1043.
