Some advisors send their clients to low-cost trust mills, trying to save them money. Trouble is, cookie cutter trusts do not protect families, and that is the whole point of estate planning. Bespoke (or custom) gun trust planning is important in EVERY state because it is the ONLY effective way to transmit a legacy of firearm training, and that’s the only way to preserve gun culture and our right to bear arms. But in California, special gun trust planning may be necessary even to avoid probate! So EVERY trust I draft for a California gun owner is a purpose-built gun trust.

Dementia doesn’t happen all at once. It waxes and wanes but gets worse over time. One day you win the presidency with a record number of votes, and the next you are shaking hands with an invisible person or being guided around by the Easter Bunny. Good days and, bad days. Make sure you visit your estate planning attorney on a good day; otherwise, life can get very complicated for your children.

When it comes to estate planning, some like it simple. Low-price trust hawkers like simple because all they can do is simple. Customers like simple because they’re told they can save money by avoiding expensive lawyers. After they die, they find out that simple failed to protect their family. And that was the whole point of having an estate plan! Simple can get very complicated.

Radio Ad 11 – Second Opinion

If you are having a trust drafted, be sure to get a second opinion. Take advantage of my free initial design meeting. There are many options out there, from many sources, at many price points, sometimes even free of charge. Why are these trusts priced so low? Because you won’t know whether the trust works until after you die. And that’s a little too late.

Radio Ad 10 – Prop 19

For most families, Prop 19 means you can no longer pass real estate to kids without reassessment, raising property taxes higher than the kids can afford. Prop 13 trusts avoided Prop 19, but that loophole closed several years ago. Some families may still avoid reassessment with advanced LLC planning, and every family must know how to step carefully through the Prop 19 minefield.

Radio Ad 9 – Farm & Ranch Planning

If you own a farm or ranch, you may want to keep it in the family forever. You’ll want to treat non-farming family members fairly, but maybe not equally. You’ll want to keep the court system away, have separate operating and land-owning entities, and avoid disqualification from any federal farm subsidies. And you’ll definitely want to avoid any estate tax which could force sale of the farm.

Radio Ad 8 – Estate Tax

If you have an estate worth millions, whether a business or farm or ranch or just a lot of real estate, then you need to be concerned about estate tax. Under current law, the exclusion amount will soon drop in half, and Congress can reduce it further at any time given budget concerns. Even if you are under the exclusion amount, your estate plan should include flexible tax planning, just in case.

Radio Ad 7 – Sudden Adult Death Syndrome (SADS)

It’s called Sudden Adult Death Syndrome, or SADS, a sharp increase in excess deaths among young adults over the last couple years. Why? I couldn’t say. Other than maybe global warming, I can say that. Regardless of the cause, excess deaths are a reality. Your estate plan could fail if a family member dies out of the expected order and your plan is not designed properly.

Radio Ad 6 – Optimal Tax Planning

Is your current plan vulnerable to high trust income tax rates? Flexible trusts can avoid these high rates, and still provide lifelong asset protection to beneficiaries. Is your old-style AB trust growing a capital gains monster? Smart basis planning wipes out capital gains with selective step-up, blocking any step-down in basis, and you are still protected from estate tax.

Radio Ad 5 – Duty to Bear Arms & Train Family

Russian forces are near my wife’s family in eastern Ukraine. They’ve bombed HOMES and killed KIDS.
So Ukraine hands out thousands of rifles to people with NO PRIOR TRAINING! Does that make ANY sense?

Radio Ad 4 – Bloodline Protection

You want to keep your wealth in the family. It’s called bloodline protection. Outright distribution, immediately or delayed until a certain age, is a bad idea because it can be squandered, lost through divorce, or taken by creditors and predators. A subtrust for life can work, if drafted correctly.

Radio Ad 3 – Firearm Training

The guardians for your kids–are they trained to bear arms? Do they, regularly? Does your plan leave a Legacy of Firearm Training–not mere plinking, but real training with objective standards like drawing and firing a controlled pair at close contact in one second flat, or performing an emergency reload in one second flat?

Radio Ad 2 – Blended Families

Many families are blended, with children from prior relationships. Traditional families may become blended upon remarriage after divorce, or after death way off in the future. The surviving spouse can easily disinherit the kids, on purpose or by accident, so proper planning is a must for blended families.
