I spoke yesterday on California Gun Trust Planning at the Atascadero Rotary Club and was asked whether a gun trust can help avoid application of California’s one gun a month law which prohibits purchase of more than one firearm over a thirty-day period (aka “1-in-30 ban”).

My presentation is clear that a gun trust in California is NOT a way around transfer rules, and i reminded him of this.

I also told him i thought the law was blocked in federal court a few months ago but i haven’t had time lately to keep up with all the 2A litigation going on. (Partly this is due to my own litigation. Still waiting for entry of judgment on a simple Rule 68 offer/acceptance. Work has really piled up for federal judges as they try to run the Executive Branch.)

Anyway i checked on the status of Nguyen v Bonta and it looks like everything is frozen at the Ninth Circuit level with no new developments since its stay was reversed on August 15, 2024, allowing the district court’s judgment and injunction to take effect and block this unconstitutional law.
