Attorney David R. Duringer has filed a 92-page federal complaint (Duringer v Morro Bay) in US District Court, Central District of California, against the City of Morro Bay and several other defendants, for violation of his civil rights under the US Constitution, specifically under the First Amendment, the Second Amendment, and the Fourteenth Amendment. Duringer seeks declaratory relief and various damages under 42 USC §1983, including $1,000,000 in punitive damages. No injunctive relief is sought as Duringer already has a concealed carry permit (CCW) and while he does not waive his constitutional right to open carry, he does not at this time seek damages for deprivation of the right to carry in that manner.

Five causes of action are alleged:

  1. Denial of Right to Bear Arms (2A, 14A)
  2. Retaliation Against Offer of Firearm Training by Political Candidate (2A, 14A)
  3. Retaliation Against Political Speech by Political Candidate (1A, 14A)
  4. Denial of Right to Procedural Due Process (14A)
  5. Denial of Right to Equal Protection of the Laws (14A)

Punitive damages are justified due to the egregious nature of the simultaneous deprivation of several separate and distinct civil rights, contrary to clearly established legal authority, to the point of misrepresenting and obfuscating that authority and even falsifying public records.
