Not the same disparity of force perhaps, but if suspect may have been able to obtain his gun. Jury will decide. Best we can say in training: “If you have to think about whether to shoot, you should probably not shoot.”

“You can use whatever means necessary to protect somebody from serious injury or death, whether it’s another person or themselves,” Mulder said.He added, “From our investigation, it appears to us that the intervening witness was attempting to protect the female victim, and then when he tried to protect the female victim he became in defense of his own self. Is that the perfect situation? That’s something we’ll leave up to the prosecutor’s office to make a final determination.”
